Details of your mortgage arrangements, confirmation of how long you have owned your property and details of the source of monies invested in property.

To perform ‘know your customer’, anti-money laundering and counter terrorist financing requirements, as required by law.
Proof that you have sufficient funds to support an offer that you make to buy a property.

 

Financial information such as copies of bank statements or an agreement in principle from your mortgage provider.

 

To provide evidence of the source of funds you will be using to buy a property.

We may record telephone calls for the purposes of training or for the purposes of retaining a contemporaneous note of interactions.

Direct Contact – personal information that you share with us when you fill in forms or contact us by post, phone, email, social media, our website or similar; or through online portals when you enquire about any of our services, products or promotions

Indirect Contact – personal information you disclose to third parties including, but not limited to, house builders and developers or through online portals; or which is available through publicly available sources such as Land Registry, the Electoral Register, Companies House, next of kin of delegated authorities.

We will process the information you provide or we obtain from other sources to provide you with services and answer your questions. Under data protection legislation we are only allowed to use your personal information if we have a legal basis to do so.  We rely on the following legal bases to process and use your information:

For employment related purposes

To fulfill contractual obligations – this is where we need to collect and process your personal information in order to perform a contract to which you are a party, or in order to take steps at your request prior to entering into a contract.

Who we share your personal information with

Personal data we share within Hayman-Joyce Broadway  – we may share your data within our group companies, where necessary, for the provision of services.  The Hayman-Joyce Broadway Group of companies includes all subsidiaries.

Personal data we share with third parties – we will share personal information with our regulators, government or quasi-government organisations, law enforcement authorities, courts, tribunals and arbitrators as may be needed from time to time in order to comply with our legal and regulatory obligations.  Where we engage third party providers to provide services on our behalf , we provide them with only the personal information they need to perform the service we request.  This includes IT systems providers who have occasional access to personal data we hold for maintenance and trouble-shooting purposes, and third party referencing agencies for the purpose of prevention and detection of crime.  We hold contracts with these third parties to protect data privacy.

How we keep your personal information secure

We are committed to protecting your privacy and follow strict security procedures to ensure that your personal information is not damaged, destroyed, misused or disclosed to a third party without your permission  and to prevent unauthorised access. All systems have protections in place to protect against unauthorised access and other external factors that could cause damage to your personal information.  There are strict access requirements in place and access is restricted to necessary staff.  Hard copy paper files are stored securely.

Data Protection training is given to all staff who need access to and process any personal information.

Where information is shared with third parties, similar security measures are used to protect your personal information.

 

How long we keep your personal information for

We will retain your information for as long as is reasonably necessary for the purposes set out in the privacy notice, and to fulfil our legal and regulatory obligations.  Most client information is kept for the duration of the contractual relationship and for 10 years after the end of the contractual relationship.  For prospects information is kept for 7 years.

Your rights in relation to your personal information

Where we have asked your consent for the use of your data you may withdraw it at any time.  We may only then process your data if we can establish a need to do so.

Your right of access – you have the right to ask us for copies of your personal information.

Your right to rectification – you have the right to request that inaccurate information is rectified and incomplete information completed.

Your right to erasure – you have the right to request your personal information be deleted by us in certain circumstances.

Your right to restrict processing – you have the right to ask us to restrict the processing of your personal information in certain circumstances.

Your right to object to processing – you have the right to object to the processing of your personal information in certain circumstances.

Your right to data portability – you have the right to request whether and to where we may have transferred your personal data.

Your rights related to automated decision making and profiling – you have the right not to be subjected to a decision based solely on automated processing which may significantly affect you.
